02. Data protection policy
DarwinAssociates is committed to the protection of privacy and personal data.
DarwinAssociates is committed to implementing adequate measures in order to ensure the protection, confidentiality, and security of the personal data of any person from whom data is collected; all these measures are in compliance with legal requirements:
- Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data (RGPD);
- French Data Protection Act and Ordinance No. 2018-1125 of December 12, 2018 on the protection of personal data amending Act 78-17 of January 6, 1978 on data processing, files and freedoms and various provisions concerning the protection of personal data;
- Privacy Directive: Regulation of the European Parliament and of the Council on privacy and personal data protection in electronic communications, v3 of which will repeal Directive 2002/58/EC and strengthen the cookie management policy.
The purpose of this data protection policy (hereinafter the "Data Protection Policy") is to inform you of all commitments made by DarwinAssociates to ensure that your personal data is respected.
Scope of application
This Data Protection Policy applies to all processing of personal data by DarwinAssociates, as Data Controller, within the European Union, relating to external persons (hereinafter "you").
Definition
"Personal" : means any data that directly or indirectly identifies a human person.
"Data processing" : operations carried out on personal data, meaning the collection, recording, use, transmission or communication of these data.
"Data controller": the legal entity responsible for determining data processing purposes and how these data have been used.
"Sub-processor": a legal entity that processes personal data on behalf of the data controller.
Collected data
DarwinAssociates ensures it collects and processes personal data that is relevant, adequate, not excessive, and strictly necessary to achieve the purposes that have been previously determined. DarwinAssociates takes all reasonable steps to ensure that your data is accurate, complete and, where necessary, kept up to date. We process personal data that you may communicate to us, specifically during the following operations:
- When you have entrusted DarwinAssociates with an assignment;
- When you wish to apply for a job offer at DarwinAssociates;
- When you wish to contact us to ask questions or make complaints.
In this context, DarwinAssociates may collect and process the following personal data
- Your identity: first name, last name, title, date of birth, position, company; commission; political party;
- Your contact information: postal address, email, telephone number;
- Your application information: CV and cover letter;
- Any information you shall choose to give us.
The mandatory nature of the information you must provide is generally indicated when there is a data collection; it is indicated by an asterisk in the forms. Any failure to respond or any response deemed abnormal by DarwinAssociates may result in DarwinAssociates's refusal to consider your request. You undertake to ensure that all your personal data communicated to DarwinAssociates is up to date, accurate, complete, and unequivocal.
Data collection purposes
DarwinAssociates is committed to collecting and processing your Personal Data in a fair and lawful manner. The processing carried out by DarwinAssociates meets explicit, legitimate, and determined purposes. Your data may be processed for the following purposes:
- To send you information via newsletters or relevant monitoring reports,to advise you and to put you in contact with others; in this context, the processing is based on DarwinAssociates; legitimate interest, i.e. listening to and analyzing opinions, advising and putting you in contact with others, which are the core business of Darwin Associates;
- To monitor your application file; in this context, the legal basis for the processing is the legitimate interest of DarwinAssociates, more specifically its interest in responding to your application requests and in finding suitable profiles for the positions available within DarwinAssociates.
We collect and store this data for a limited time period on the basis of our legitimate interest in order to induce derivation of personal data in the event of unauthorised access or attempted access to local servers (article 6 para. 1(f) GDPR).
Information regarding collected data
In accordance with the French Data Protection Act, Darwin Associates undertakes to inform you about the processing of your personal data. Thus, DarwinAssociates informs you clearly:
- The identity of the data controller (this is the legal entity of Darwin Associates responsible for processing your data);
- The purpose for which your data is collected;
- The recipients of the data;
- How long your data will be kept;
- The existence of and procedures for exercising your rights of inquiry, access, rectification, and opposition with respect to all data concerning you.
Recipients of the collected data
Only our company is the recipient of these personal data. DarwinAssociates only communicates your personal data internally in the legitimate exercise of our business. Your data (First name, Last name, Position, Companies, email, phone if applicable) are only used to:
- To put you in touch with key stakeholders for the success of your strategies (opinion leaders, political figures, journalists...);
- To invite you to events;
- To invite you to speak at events.
All other data being processed are data obviously made public by the person concerned as explained in GDPR article 9 paragraph 2.
Data retention
Data related to background notes, biographies, event registrations and invitations are retained for a maximum of 6 years, i.e., which is mandate’s maximum duration. Candidate files may be retained for up to 2 years from the last contact with the candidate, unless the candidate agrees to a longer retention period. In this case, the data is archived in accordance with applicable statute of limitations.
Security
DarwinAssociates ensures the security of your personal data by implementing data protection via physical and logistical safeguards. DarwinAssociates has an internal data breach policy.
Rights of the persons concerned
In accordance with applicable legislation on the protection of personal data, you have several rights regarding the collection and processing of your personal data, namely:
- The right of access: You have the right to obtain (i) confirmation as to, whether, your personal data are being processed and, if so, to obtain (ii) access to and a copy of such data;
- The right of rectification: You have the right to obtain rectification of personal data concerning you that are inaccurate. You also have the right to have incomplete personal data completed, including by providing an additional declaration;
- The right to erasure, restrict, object and to data portability: In certain cases, you have the right to have your personal data erased. This right is not, however, an absolute right and Darwin associates may have legal or legitimate reasons for retaining such data;
- The right to complain to the supervisory authority. In case of non-compliance with the GDPR and applicable legislation, data subjects have the right to lodge a complaint with a supervisory authority such as the CNIL (French data protection authority);
- The right to give instructions regarding the use of data after death (this right is applicable in France): you have the right to give DarwinAssociates instructions regarding the use of your personal data after your death.

Darwin associates may update this Privacy Policy at any time to reflect new practices and service offerings. In this case, the date of the update of the Data Protection Policy will be updated to indicate the day on which the changes were made. It is your responsibility to check for updates to this Privacy Policy posted on Darwin associates websites. If Darwin associates makes any changes that it believes to be material, you will be notified via a notice on our website.

Use of cookies

Within our online offer, no functions and contents are offered by the service LinkedIn, LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. The LinkedIn channels are only accessible via an external link. If visitors to the website are LinkedIn platform members, LinkedIn can assign the visit to the social media channel to the user profile if the user visits our LinkedIn profile while logged in.
